This Privacy Policy (herein referred to as “Policy”) explains how BASE Fitness LLC (herein referred to as the “Company,” “we,” “us,” or “our”) processes Personal Data collected from you (herein referred to as the “Visitor”) as a Controller.

1. DEFINITIONS

(a) “Controller” means the natural or legal person, public authority, agency, or other body that determines the purposes and means of processing Personal Data, alone or jointly with others.

(c) “Service(s)” means the fitness and wellness services offered by the Company, including but not limited to fitness classes, studio access, personal training sessions, event participation, merchandise sales, and other related services.

(i) “User” means any natural person who interacts with the Company’s website, subscribes to the Service(s), or otherwise engages with the Company.

(ii) “Terms” refers to the binding contract between the Company and the User that governs the User’s access and use of the Service(s).

2. DATA COLLECTION

The User directly provides most of the data collected by the Company. Data is collected from the following sources:

Information submitted through the Company’s website, such as online forms, account registrations, class bookings, and interactions; data provided through marketing and operational software, including email campaigns, surveys, newsletters, event registrations, and third-party platforms for scheduling and payment processing; and information collected in person at the studio during class check-ins, membership sign-ups, event participation, merchandise purchases, and interactions with the Company’s team.

3. PROCESSING OF PERSONAL DATA

(a) The Company processes the User’s Personal Data to manage subscriptions and memberships, facilitate class bookings and participation, process payments, deliver merchandise, communicate updates about services, events, and promotions, improve service quality, and ensure the safety and security of User and the studio premises.

(b) The Company collects Personal Data from Users only where necessary to fulfill contractual obligations, pursue legitimate business interests not overridden by the User’s data protection rights, or comply with legal obligations. In other cases, data is collected with the User’s consent.

4. SHARING OF PERSONAL DATA

(a) The User acknowledges that the Company may share Personal Data with its group companies and third-party service providers to offer the Service(s) and/or send information or updates about the Service(s).

(b) When processing orders, the Company may share Personal Data and use information from credit reference agencies to prevent fraudulent transactions.

(c) The Company shares Personal Data to facilitate service delivery through third-party platforms (e.g., payment processors, scheduling tools, and communication providers); to comply with legal obligations; to prevent fraudulent transactions; and to protect the safety and security of the studio, its staff, and Users.

5. RETENTION OF PERSONAL DATA

(a) The Company retains Personal Data as long as there is an ongoing legitimate business need for it.

(b) When Personal Data is no longer required, the Company will delete or anonymize it. If deletion is not immediately possible, the Company will securely store the data and isolate it from further processing until it can be deleted.

6. SECURITY OF PERSONAL DATA
